Dear Mr. Brauksieck:

These comments are submitted by Energy Coalition New York ("ECNY") which consists of New York State's major gas and electric utility companies: Central Hudson Gas & Electric Corporation, Consolidated Edison Inc., Orange & Rockland Utilities, Inc., National Fuel Gas Distribution Corporation, National Grid, New York State Electric & Gas Corporation and Rochester Gas and Electric Corporation. ECNY supports the adoption of 6 NYCRR Part 570 as proposed by the New York State Department of Environmental Conservation. This proposed regulation implements a permit program for the siting, construction and operation of liquefied natural gas facilities in New York State.

There are both economic and environmental benefits associated with the use of liquefied natural gas ("LNG"). The Department of Environmental Conservation has carefully examined this issue and adoption of this regulation would enable New York to become the 50th state to permit the siting of LNG storage. The proposed regulations are subject to local zoning, building and other
appropriate code requirements prior to siting of a particular LNG project.
